TL;DRAbstract

The Compilation of Justinian, monumental work of reformation and systematization of the roman right, contains a lot of fragments relating to the animals. The collection of those paragraphs, followed by their classification, allows to discover, into a legal work, the existence of a true animal dimension. The animal world in this way put together contains two types of animals : on the one hand, the servant animals, which are useful because they are closely brought to human activities ; on the other hand, the wild beasts, whose status is far more ambivalent. The analysis of the texts leads to two series of remarks. The space granted to the animals first reveals the roman utilitarist view about animal : the animal is an animated object which must, to be considered as an interesting thing, presents a real usefullness, even a real productivity. Furthermore, between the ancient period and the lower-empire, the animal status evolves in the same time and in the same way as the roman law itself.
